Liability on a Commercial Policy
Please remember when it comes to claims, it sometimes comes down to, You said, I said, situation and becomes difficult to prove you were not negligent.
Try have certain procedures in place to protect your company from being liable for heavy claims:
Have cameras set up, when it is actually footage, people can't deny what is shown
Keep weekly registers of maintenance of equipment, etc.
When dealing with the public and you offer a service where the public use your equipment,
In the event of sports grounds, jumping castles or venues, etc.
Have them sign an inventory form when they purchase the tickets, make sure they understand and each individual adult sign.
Make sure staff are trained and especially cleaning staff, put up correct signs in aisles if cleaning floors, so people don't slip.
Wipe up any spills etc.
Just be aware of any dangers to the public and try cover all angles, so if a customer comes to you a month later and says they slipped and hurt their back and want to sue you for say R2 million, will you have footage and reports to protect yourself and see if they really did?
Always take out the highest liability amount that you can afford on your policy.
With our Electricity problems in South Africa, More and more people are turning to installing Solar power and inverters and even going off the grid completely. Unless you let the broker or Insurance company know, you won't have cover should there be a claim.
Always remember send through the Invoice and COC certificate so it can be noted on your policy. This amount will be added to your Buildings sum insured amount.
