On February 20, 2026, Section 122 duty tariffs replaced the IEEPA duty tariffs after the U.S. Supreme Court struck down the use of IEEPA to impose duty. Section 122 of the Trade Act (1974) has been applied to all imported goods, regardless of their value or country of origin. Currently, the duty tariff is 10% and applies in addition to the applicable General Duty Rate (GDR). Some exemptions to this tariff apply and are described in Annex I and Annex II of the Proclamation. The Section 122 duty tariff will expire on July 24, 2026.
