"Oregon Commercial Eviction Moratorium

On Wednesday, April 1, 2020, Governor Brown placed a 90-day moratorium on commercial evictions to relieve businesses impacted by the COVID-19 pandemic.

The moratorium prevents property owners from evicting tenants for lack of payment during the stipulated period, if the tenant's financial hardship is due to the effects of public health measures related to COVID-19.

In order to rely on the moratorium, tenants must follow certain rules.
Demonstrate substantial loss of income, through documentation or other objectively verifiable information, resulting from the coronavirus pandemic and the associated government restrictions; and
Notify their landlord on or before the rent due date that the tenant is unable to pay rent due to the substantial loss of income as a result of the coronavirus pandemic.
It is important to understand that tenants are still responsible for rent payments but are not required to make them until six months after the order expires (October 30, 2020, based on the current order), and a landlord cannot charge late fees based on the delayed payments.

In addition, the Oregon Supreme Court Chief Justice issued an amended emergency declaration that effectively paused all eviction proceedings statewide. The order applies at all Oregon circuit courts and Oregon appellate courts. While the order still allows for landlords to file eviction complaints, it postpones all first appearances until after June 1, 2020. However, for cases where a first appearance has already occurred, the landlord may file a motion requiring the tenant to pay rent into the court until the trial occurs.

All commercial tenants should be proactive and maintain an open line of communication with their landlords, following up on conversations with written confirmations, usually in the form of an email."
