The New York Times reported on a recent decision in one of our cases. The U.S. District Court granted our motion for sanctions, imposing nearly $110,000 in monetary sanctions and dismissing the opposing party's $12.6 million claims with prejudice. We found citations in their briefs that were not citations to real cases or were citations to cases that did not stand for the points of law for which they were cited. Their briefs also contained numerous incorrect quotes from court opinions.
The decision addresses a disturbing and growing trend in the legal profession: lawyers filing AI-generated legal briefs without verifying the accuracy of the cases cited in those briefs. In this case, the plaintiffs' attorneys filed briefs drafted by one of their clients without verifying the content of the briefs. The client's role, and a failure by anyone to take accountability for fake citations contained in three briefs, justified the dismissal of the plaintiffs' claims.
Whether used by attorneys or clients, AI tools do not replace the duty to ensure that what is filed with the court is accurate, substantiated, and truthful. Courts are holding parties accountable when they fail to perform that duty.
