⚖️ In 2006, the United States Supreme Court told Arkansas it could take only the portion of Ahlborn's settlement attributable to medical expenses. The reasoning was straightforward. The federal anti-lien statute at 42 U.S.C. § 1396p(a)(1) bars liens against a Medicaid recipient's property before death.
📖 The narrow exception in the assignment statutes reaches medical payments. Nothing else.
📉 Where total damages exceed the settlement, the pro-rata methodology Ahlborn endorsed reduces the lien in proportion. A settlement that recovers one-sixth of total damages reduces the lien to one-sixth of the amount Medicaid paid.
💡 That math has shaped every Medicaid lien reduction since.
