The United States Constitution requires a two-step process for any amendment: a proposal (either by a two-thirds vote in Congress or a national convention requested by two-thirds of the states) followed by ratification (by three-fourths of state legislatures or state ratifying conventions).Under Article V of the Constitution, these specific rules must be followed:1. ProposalAn amendment must be proposed by one of two methods:Congressional Vote: A two-thirds supermajority vote is required in both the United States Senate and the House of Representatives. (Every one of the 27 amendments in U.S. history has been proposed this way).Constitutional Convention: Congress must call a national convention for proposing amendments if the legislatures of two-thirds (34) of the states petition for one. This method has never been used.2. RatificationOnce an amendment is proposed, it must be ratified by one of two methods, as determined by Congress:State Legislatures: Three-fourths (38 out of 50) of the state legislatures must vote to approve the amendment.State Conventions: Three-fourths of states must approve the amendment via specially elected state ratifying conventions. (This method has only been used once, for the 21st Amendment).Additionally, Congress has the authority to set a reasonable time limit for the states to complete the ratification process.
