H.R. 3166, the Enemy Expatriation Act, allows the government to strip someone's US citizenship without the approval of any judge or court, so long as they are accused of engaging or purposefully and materially supporting hostilites against the US. They key is how this language is interpreted by those who officially accuse people of committing these acts.

New Bill Known As Enemy Expatriation Act Would Allow Government To Strip Citizenship Without Convict Congress is considering H. R. 3166 also known as the Enemy Expatriation Act. This bill would give the US government the power to strip Americans of their citizenship without being convicted of being 'hostile' against the United States.
