ACS routinely misuses this power — meant only for rare, truly urgent situations when there is not enough time to get a court order — regularly bypassing judicial review despite having ample time to seek court authorization.
This policy violates families’ fundamental right to remain together. This government overreach causes deep and lasting harm, especially to Black and Latino families who are disproportionately targeted.

BREAKING: A federal court today issued an emergency order preventing the Trump administration’s termination of Temporary Protected Status (TPS) for Yemen, granting a victory to a class of Yemeni immigrants who sued to preserve the program.
Under the order, TPS will remain in place pending the outcome of the class action lawsuit, which says the administration’s termination of the program violates the Administrative Procedure Act and the Fifth Amendment. TPS had been due to expire at midnight on May 4.
“The ball is now firmly in the Supreme Court’s court. Sixteen lower courts have unanimously ruled against the Trump administration in finding that the judiciary can at least hear and decide these claims," said Managing Attorney Shayana Kadidal. "The fate of 1.3 million TPS holders will now turn on whether the Justices have the good sense to rule the same way.”
