The OLG Zelle (Urteil vom 29.10.2020 - 6 U 34/20) decided that in the recording of a notarial record of the estate, the scope of the investigation of the estate inventory is not solely at the discretion of the notary. The notary must make those investigations that an objective third party would consider necessary in the position of the creditor.

Das OLG Zelle Entshcied, dass bei der Aufnahmen eines notariellen Verzeichniees über den Nachlass steht der Umfang der Ermittlungen über den Nachlassbestand nicht allein im Ermessen des Notars. Der Notar hat diejenigen Nachforschungen anzustellen, die ein objektiver Dritter in der Lage des Gläubigers für erforderlich halten würde.
