ICE is launching a nationwide operation today, Friday 10/3, reportedly named “Freaky Friday” that will target unaccompanied children aged 14 and older of all nationalities.
The American Immigration Lawyers Association (AILA) has received information from several trusted sources. AILA is confident this is happening (and is not a rumor). Here is what we know:
1. Children detained and released will be sent a “threat” letter from ICE threatening indefinite detention and immediate transfer to ICE upon age-out if they do not waive jurisdiction under the TVPRA and withdraw applications for relief, including withdrawing their request for admission with EOIR.
2. Children will be offered $2,500 to return to their countries of origin.
3. If children do not comply with the “offer”, the letter indicates their parents/family living in the US will be arrested.
4. ICE plans to detain all age-outs, and they anticipate legal challenges.
5. It is possible that the age threshold for this threat letter may be lowered to youth 10 years old and older.
6. ICE will first target detained children, but will also target children released from custody.

Yesterday, the U.S. Supreme Court gave ICE broader authority to justify arrests based on whether someone “looks like” an immigrant, in this case, Hispanic, and whether they are speaking another language, in this case, Spanish.
U.S. citizens and those with lawful status who are wrongfully detained should eventually be released once they prove their status. But to avoid the trauma, danger, or risk of physical harm that can come from being arrested by ICE in the first place, please, please carry proof of your status or your US citizenship with you at all times.
Separately, the Board of Immigration Appeals (BIA) has issued a deeply troubling decision: people who are detained are now considered subject to mandatory detention (meaning no eligibility for release on bond) if they entered without permission, even if they were brought to the U.S. as children or heck are children themselves now. This ruling flies in the face of both logic, existing law, and compassion.
Please, be extremely careful. These decisions reflect the harsh shift in immigration enforcement.

USCIS has announced that it "may" start issuing Notices to Appear (NTAs) to people who are beneficiaries of I-130 petitions "if they are otherwise removable". That means individuals who are trying to follow the legal process, doing everything “the right way,” could now face removal proceedings simply for coming forward.
This is a heartbreaking shift in policy. It’s one of many, many ways this heartless administration is making our immigration system more punitive, less humane, and hostile to immigrants and their families.
I’m frustrated. I’m angry. But Levesque Law remains deeply committed to fighting for our community and for a system that treats people with fairness and dignity.
