Today, the U.S. Supreme Court held that candidates have standing to challenge unlawful vote-counting rules in federal court—before an election is over.
That matters to everyone who cares about lawful elections.
For years, courts dismissed challenges by saying: “You can’t sue unless you can prove the rule will change the outcome.” Federal courts would force litigants into state courts that refused to act or ran out the clock. That standard kept illegal election practices insulated from review until it was too late.
No longer.
The Court recognized a basic truth:
Elections are not legitimate if votes are counted unlawfully—even if the margin is large.
This decision means:
Illegal vote-counting rules can be challenged early, not after the damage is done
Courts can no longer hide behind technical standing barriers
Election integrity claims get heard on the merits
