Congratulations to Practus partner, Michael Greene, on a recent client success in which he helped a broker-dealer resolve a FINRA enforcement action.
The firm had fallen behind in reviewing securities transactions occurring in its associated persons’ disclosed outside brokerage accounts under FINRA Rule 3110(d)(1)(C). A routine cycle exam caught it, and FINRA Enforcement got involved.
Michael guided the firm through every stage. He prepared responses to FINRA's Rule 8210 requests, negotiated the terms of the Acceptance, Waiver, and Consent, and helped reduce the fine FINRA initially proposed. He also worked with the firm on the written certification confirming the supervisory gaps were fully remediated.
The result? Michael got the firm's proposed fine reduced and resolved the matter on favorable terms.
This case is proof that the right counsel negotiates from a position of understanding, not guesswork, and that difference protects a firm's time and resources.
