Here’s some perspective on the recent case from the Marvin Gaye estate which just lost in US court against Ed Sheeran. I’m actually surprised Rick went as far as he did with this, but he has a point.

I think this is a correction by the courts knowing how ridiculous the “Blurred Lines” case was. Based on this case, I’d hope that Pharrell Williams has an appeal left(but legally, I think he exhausted them all?), because if “Thinking out Loud” doesn’t qualify for infringement, there’s NO way the “Blurred Lines” case does.

I think there’s no question that “Let’s Get it On” was an influence in the writing of “Thinking out Loud”, but influence, groove, or chord progressions have never been prosecuted successfully before and the “Blurred Lines” case opened a very slippery slope.

I have many opinions as to why this was brought and why it was even entertained by the court, and there’s definitely a deeper conversation around cultural appropriation here, but, legally speaking, I’m glad this ruling went the way it did. I’m sure Pherrell is like “WHAT???” right now (and rightfully so). But, hopefully, this has served as a course correction for a while.
