Spalding County Data Centers, pt. 2

Enforcement

So, Spalding County has the highest rules restricting data centers in the state, so what? The giant companies can just pay the fines, no matter how high they are they won't really follow the rules!

Wrong!

Spalding County has tied compliance to all our strict rules with the company's certificates of occupancy. That means that if they break our rules they will lose their CoO and thus be forced to close their doors or come into compliance.

This happens automatically (meaning without a future vote from the commissioners), so they can't weasel out of it via unscrupulous means.

How do we know if they are violating the rules?

It depends on the rule.

Most would be enforced by code enforcement (for obvious reasons) but others would be detected by others such as the Spalding County Water and Sewage Authority who would know of they were using more water than they are allowed or the river keepers who would know of their Runoff was causing any issues with the ground water or rivers, etc. All those groups would be closely monitoring any data center to ensure compliance.

Also, those citizens that live close or drive by would be extra sets of eyes and ears to enforce other rules such as the county's noise ordinance or other nuisance laws, which they would report to County Code Enforcement for investigation and citations if needed.

As far as set backs, berm height, planted barriers requirements and the actual building being to code would be planning and zoning and our building inspectors. Together they would ensure they only built according to code and followed all the rules we've set up for them.

The decommissioning rules would be enforced by both code enforcement and planning and zoning as well as the building inspectors who would have to give the final all clear should a data center ever be decommissioned.

In the next post, I'll discuss what some of the rules and restrictions are.

There are no citizens blocked from accessing, viewing or interacting with this very public official page nor have ever been. At no point has this very public page dedicated to Commissioner James R. Dutton ever blocked any person other than spam bots which have been reported to Facebook and then subsequently deleted.

I repeat; there are no citizens blocked from the very public Commissioner James R. Dutton page.
