Deciding who will raise your kids is a question most parents answer once, at the attorney's office when signing their will, and then never revisit.
What I see happen is the named guardian moves to another state, or the relationship changes, or they're simply no longer the right fit. The nomination is still in the document. Nobody updated it. In many cases, a nominated guardian who cannot or does not formally accept the appointment loses their statutory priority, at which point Genesee County Probate Court may open a proceeding and any interested person may petition.
A guardian named in a Michigan will carries the highest legal priority the court recognizes. That only holds if the person named is still the right person and still willing to say yes.

Cue the fireworks, fire up the grill, and get ready for what might be the most ambitious birthday cake of all time. 🎂
America turns 250 this year, which means 250 candles on the cake … so someone should probably alert the fire department.
However you’re celebrating the Fourth of July, we hope it’s filled with great food, good company, and a sky full of fireworks.
