Myth Mondays!
Myth: If the builder’s warranty expired, the HOA has no legal options left.
Reality: Builder warranties are separate from statutory rights and legal claims. Depending on the state, HOAs may still have rights under statutes of limitation and statutes of repose related to negligence, breach of contract, or building code violations even after a warranty period ends.
Timing is critical, though, because deadlines vary by jurisdiction.
