Wage Determination: The role must meet the prevailing wage for the specific area of employment.

Employer-Driven: The employer takes the lead, filing the I-140 petition based on a full-time, permanent job offer. This model provides a stable, structured framework, but it inherently limits flexibility and professional mobility while the process is ongoing.

The EB-2 NIW Path: An Endeavor-Based Model

The National Interest Waiver (NIW) pathway is centered on the impact of your work rather than a specific job offer. It is designed for those whose contributions have a broader national significance.
Substantial Merit & National Importance: You must demonstrate that your proposed endeavor has substantial value and impacts the U.S. on a broad scale.

Well Positioned: You must show that you have the necessary skills, experience, and track record to succeed in your endeavor.
Petitioner-Driven: You drive the case based on merit and impact, allowing for the waiver of the job offer and labor certification requirements. This model is built for professional mobility and independence, focusing on the continuity of your contributions to the U.S. national interest.

At its core, the EB-1 visa acknowledges individuals who have demonstrated exceptional ability, achievement, and impact in their field. While the ultimate goal is the same—contributing to the United States—the journey can take one of three distinct routes:

EB-1A: Extraordinary Ability
For individuals with extraordinary ability in the sciences, arts, education, business, or athletics.
Key Traits: Sustained national or international acclaim, recognized as a leader, and evidence of significant contributions and impact.

Example Roles: Researchers, entrepreneurs, professors, executives, artists, athletes.

EB-1B: Outstanding Professors or Researchers
For outstanding professors or researchers with at least 3 years of experience in teaching or research.
Key Traits: International recognition in their academic field, at least 3 years of experience, and evidence of outstanding achievement in teaching or research.

Example Roles: University professors, research scientists, academic thought leaders.

EB-1C: Multinational Managers or Executives
For executives or managers transferring to the U.S. to work for a U.S. employer or its affiliate.
Key Traits: Managerial or executive capacity, employed abroad by a qualifying organization for at least 1 year in the past 3 years, and transferring to work in the U.S. in a managerial or executive role.

Example Roles: CEO, COO, director, department heads, senior managers.
