DALLAS’ “WHALING WALL” MURAL UPDATE INCLUDING A $25 MILLION LAWSUIT

If you’ve been wondering what is happening with the whale mural, we have updates!

A BIG BLUE WALL NOW
The mural has been paused but not before about 95% of the primary wall of the mural was painted over. There’s now still a tiny sliver in the upper right corner but the left side of the mural that wraps around the building was actually left untouched.

HOW/WHY WAS IT PAINTED OVER IN THE FIRST PLACE?
FIFA was scouting walls for murals across the city, like the one recently finished on the Trinity Park Conservancy building. The President and CEO of Downtown Dallas, Inc. released a statement sharing that they were, “part of early discussions regarding the wall in question and introduced the North Texas FWC Organizing Committee with the building owners. DDI did not commission, fund or manage this project.”

THE $25 MILLION LAWSUIT
The artist is suing for copyright infringement and permanent destruction under the Visual Artists Rights Act, which protects notable public art from being destroyed without consent. The lawsuit claims FIFA and the property company intentionally destroyed a monumental piece of heritage for corporate ad space. He is seeking $25 million in damages.

WHAT WOULD WYLAND DO WITH A SETTLEMENT?
According to Fox 4, Wyland would not keep any settlement for himself, but instead would “donate directly to communities, conservation, and school art programs.”

AND DID HE GIVE APPROVAL ORIGINALLY?
The City of Dallas actually is claiming that Wyland’s team was notified but according to D Magazine, “despite the City of Dallas’ claims, [Wyland] was not consulted prior.”

A NATIONAL PRECEDENT?
This lawsuit is being covered on a national scale and could set a precedent for public art protection moving forward. Shared to Fox 4, Wyland noted that “If they can get away with it, then all the public art in Dallas and in America is at risk.”

It will be interesting to see what happens from here, especially as according to the Dallas Morning News, this is believed to be “one of the largest lawsuits ever brought regarding the protection of works of recognized visual art.”

POPUP BAGELS OPENS SECOND DALLAS LOCATION ON HENDERSON AVE. 🥯

After a highly anticipated (and successful) opening off Lovers Lane, has officially opened its second Dallas location on ! Their official grand opening is tomorrow, June 5, from 7–11 am, featuring extra-hot bagels and an exclusive jalapeño cheddar schmear.

ABOUT POPUP BAGELS
started as a backyard hobby in Connecticut before becoming a nationwide sensation backed by notable names like Paul Rudd and JJ Watt. Their concept is simple: do one thing really well. That means no sandwiches, no toasters, and no complicated menu, just fresh bagels paired with their signature rotating schmears!

THE EXPERIENCE
Their famous “grip, rip, and dip” method is exactly what it sounds like. Tear off a piece of bagel and dunk it into your schmear of choice! Guests choose three bagels from five daily flavors and pair them with a carton of schmear. We tried the spicy scallion schmear and salted butter with the sesame, salt, and everything bagels!

KNOW BEFORE YOU GO
The grand opening is tomorrow, so we’d recommend getting there early if you’re hoping to snag your favorite flavors. That said, they seem to have the process down to a science and the line moves surprisingly fast!
