Did you know that not every person in every case has a right to an attorney? The Constitution and other laws give you the right to an attorney in cases where it is possible to loose your life, liberty or children. In other words, most criminal and DCS cases.

Also, did you know you don’t always have the right to an appointed attorney? Even if you have the right to an attorney in a case you may not qualify for a “free” attorney. There is a form that you fill out if you want an appointed attorney, the judge will look over it and according to the rules, decide if you qualify. Most situations are income based, so if you qualify for other government assistance, you probably qualify for a “free” or reduced payment lawyer.

Last tip -most often your “free” lawyer will cost you something. Often a $15-$20 payment is required even for the lowest income defendants. Never be afraid to ask what your costs are. Just be respectful and never talk out of turn.
