DISMISSED! — After a dispute lasting more than four years, the Erwin Law litigation team successfully obtained dismissal of a lawsuit that threatened to upend our clients’ right to enforce a restrictive covenant which protected their home from unwarranted construction next door. Despite Plaintiff’s scorched earth attempts to void a party wall agreement that had been in place and uncontested since 1946, we finally prevailed on dueling motions, obtaining an order dismissing Plaintiff’s claims in their entirety. Opposing counsel offered every conceivable argument and a myriad of tough litigation tactics at the case, requiring our steadfast determination, focus and skill to cut out the noise and persuade the judge to rule in our favor. We are thankful to have been able to help these clients protect and preserve the architecturally significant home which they have owned for almost 40 years.
