The Truth About Section 875 of the FY2026 NDAA—It's Not a Communication Blackout

If you've heard that contracting officers are now "silenced" under the new rules, here's what's actually happening:

What Section 875 Really Does: Section 875 is designed to discourage incumbent contractors from filing bid protests at the GAO that extend performance through bridge contracts or contract extensions. If the protest is dismissed as frivolous, the government can withhold up to 5% of the incumbent's payments.

What It Doesn't Do:
❌ It does NOT restrict contracting officer communication
❌ It does NOT eliminate pre-award discussions
❌ It does NOT create a "procurement blackout"
