What are the main stages for the green card process – employment-based pathway (by employer)?

Step 1: (a) The permanent labor certification program (PERM) process is the 1st in a series of correspondence that establishes job detail for which the employee is being sponsored during the process. Overall~ 2-4 months.

(b) Request prevailing wage from department of labor (DOL). The DOL will determine the wage based upon location, job duties and requirements. Overall~ 6-9 months.

(c) Conduct recruitment. After step(b), advertisements will be placed to test the labor market. Overall~ 2+ months.

(d) Submit PERM to DOL. Once there is no suitable U.S. based qualified workers – the PERM application will take ~ 5-6 months.

Step 2: File the I-140 petition. This step involves applying to the USCIS to classify the applicant as an immigrant worker.
Overall~ 9-12 months – but can be premium processed to “2-4 weeks”.

Step 3: File the I-485 petition. This step is the personal green card application filed by the employee named in I-140 petition and their derivative family members (spouse and children).

Overall~ variable which can take around 24+ months (but dependent on geographical location).

What are the three main green card pathways for scientists/researchers?

The EB-1A is for individuals with extraordinary abilities in the science field and such persons are not required to have a prospective employer (unlike EB-1B or EB-1C), but they must be entering to continue to work in their chosen field and must substantially benefit prospectively in the U.S.

The EB-1B is for a priority worker and to qualify you must demonstrate international recognition for your outstanding achievements in your academic field of endeavor. You must have at least 3 years of experience in research or teaching in that academic area. A tenure track or permanent job offer is required.

The EB-2 National Interest Waiver (NIW) category is for a priority worker under the second preference (EB-2) and this category does not require employer sponsorship or a Labor Certification. The foreign national must have an advanced degree (MSc, PhD or similar) have evidence of significant merit and national importance.
