Verdict Alert! $2.55 Million Dollars

Dyson Law, with co-counsel Law Offices of Joseph A. Bosco, P.A. secured a verdict against Publix in a negligent security and negligent warning case.

After a week-long trial, a Palm Beach County jury awarded $2.55 million to our client, Tocka Hardaway, who was shot in the foot outside a Publix store. The jury found Publix 80% at fault for failing to warn customers that an assailant was pointing a gun outside the store.

Evidence showed that several Publix employees saw the threat and called 911 — yet no warning was given to customers leaving the store. Moments later, Ms. Hardaway was shot in the parking lot.

For years, Publix had blamed Ms. Hardaway for her own injuries, but the jury rejected that argument entirely, finding no comparative fault on her part. Ms. Hardaway says she feels vindicated by the verdict and grateful that a jury finally held the company accountable.
