NAR REAL ESTATE LAWSUIT!

HERES THE REAL INFO — NOT THE FLUFF THE NEWS OUTLETS ARE SPEWING

You might have read online or saw on the news that the National Association of REALTORS has reached a settlement in a class action lawsuit regarding real estate commissions. It still has to be approved by the courts, but it looks like that is likely. If it is approved it will go into effect in Mid – July.

The key part of the settlement is that sellers will no longer be required to offer buyer agent compensation through the MLS system. Buyers will also now need to work with an agent under a written Buyer Representation Agreement, similar to a Listing agreement with sellers.

So, does this mean buyer's agents won’t be compensated? No, buyer’s agents will be compensated either directly by the buyer or through a negotiation with the seller in the offer agreement. The advantage of the seller paying the fee is that the commission becomes a transactional cost that can be financed by the buyer. If you own a home now that is likely exactly how your agent was compensated.

The bottom line is that every transaction will be a unique negotiation regarding who pays the real estate commissions and how they are financed into the transaction.
