A living trust is a legal arrangement that allows an individual (the grantor) to transfer assets into a trust during their lifetime. The trust is managed by a trustee, who holds and manages the assets for the benefit of the trust's beneficiaries. A living trust can serve several purposes, including:
Estate Planning: A living trust allows the grantor to plan for the distribution of their assets after their death, without the need for probate court. This can save time and money, as well as ensure that assets are distributed according to the grantor's wishes.
Asset Protection: Assets held in a living trust are protected from creditors and can be protected from estate taxes, making it a valuable tool for estate planning.
Management of Incapacity: If the grantor becomes incapacitated, the trustee can manage the assets in the trust without the need for a conservatorship or guardianship proceeding.
Privacy: Probate proceedings are a matter of public record, while the terms of a living trust remain private.
A living trust can be either revocable or irrevocable, depending on the grantor's wishes. A revocable living trust can be amended or revoked during the grantor's lifetime, while an irrevocable trust cannot be changed once it has been established.
