We understand thereās been a lot of confusion on several Brazoria County FB pages about Insurance & Deductibles after this storm.
Several Customers wonder why we are asking them if they are filing a claim or not. People are telling other people āDonāt tell your Roofer you are doing a claimā.
Well, Per Texas House Bill No. 2102 passed on May 3, 2019 it is āILLEGALā for a Texas Roofer to waive a customers Deductible. It is considered a class B misdemeanor.
From our experience after the Hail storm we had here in April, we had several insurance companies call and ask for proof that the customers who filed an insurance claim paid their deductible.
We hope this video (from 2019 when law was passed) helps educate people and make them understand why we āHAVEā to ask if they are filing a claim and what is their Deductible amount.
Texas H.B. 2102
"Texas law requires a person insured
under a property insurance policy to pay
any deductible applicable to a claim made under the policy. It is a violation of Texas law for a seller of goods or services who reasonably expects
to be paid wholly or partly from the proceeds of a property insurance claim to knowingly allow the insured person to fail to pay, or assist the insured person's failure to pay the applicable insurance deductible."
