AI Platform Gatekeeping / Antitrust Precedent
On 9 June, the European Commission imposed interim measures on Meta, ordering it to restore free WhatsApp access for rival AI assistants within five working days. The decision is only the second use of interim antitrust measures under Regulation 1/2003, after the Broadcom case in 2019.
Meta had blocked rival AI assistants from the WhatsApp Business API while retaining exclusive access for Meta AI, and a subsequent attempt to restore access behind a fee was rejected as unsustainable for competitors. The order holds until June 2029 or the Commission's final decision. Meta announced it would appeal. Broadcom did the same in 2019, yet complied throughout and offered commitments that closed the case within twelve months.
Advisory: Organisations that rely on dominant messaging platforms for AI-powered services or customer communications should verify that their operational workflows and vendor contracts can withstand sudden access-term changes, whether imposed by the platform or mandated by regulators, as the Commission's characterisation of previously open infrastructure being closed to competitors creates a replicable enforcement template for any dominant platform that restricts third-party access.
