B. Illegitimate: natawo na waya makasal an ginikanan, kay:
Ex.
1. An nanay dyaga pero an tatay minjo sa lain.
2. An tatay ulitawo pero an nanay minjo sa lain.
3. Pareho an nanay sanan tatay minjo sa lain lain na tawo.
4. Pareho dili minjo an nanay sanan tatay pero waya sila kakasal pagkatawo nan ila bata.

CONSTITUTIONAL SUPREMACY OVER ICC?

Supreme Court Associate Justice Ramon Paul L. Hernando emphasized that the 1987 Constitution is supreme over any foreign or international tribunal in connection with a petition for temporary restraining order (TRO) seeking to block the implementation of an International Criminal Court (ICC) arrest warrant against Senator Ronald dela Rosa.

In his dissenting opinion to the majority ruling that denied dela Rosa TRO bid, Hernando stressed that no Filipino may be arrested, restrained, transferred, surrendered, or subjected to foreign or international criminal proceedings without prior authorization from Philippine courts and without the safeguards required under domestic law.

TRO VS ICC ARREST WARRANT NECESSARY TO PROTECT DELA ROSA RIGHTS TO DUE PROCESS, EQUAL PROTECTION

Supreme Court Associate Justice Amy Lazaro-Javier said granting Senator Ronald “Bato” dela Rosa’s petition for a temporary restraining order against the possible implementation of an International Criminal Court (ICC) arrest warrant was necessary to protect his constitutional rights to due process and equal protection.

In her dissenting opinion, Lazaro-Javier warned that dela Rosa could be deprived of liberty without proper judicial safeguards if he were arrested and transferred to a foreign jurisdiction without prior court determination on the legality of such actions.
