Legal Tip Tuesday! Do you think you know the difference between an Employee and a Contractor? Here’s an easy tip, look at the contract in place. Is it an employment agreement (contract of services) or an independent contractor agreement (contract for services)? But unfortunately, it’s not always that simple.

The contract between the parties is only one factor to be considered when looking at whether a person is truly an Employee or Contractor. And what happens if there is no contract in place? Well… the Courts have developed a number of legal tests to determine the “true nature” or the relationship. Let’s take a look at the “Intention Test”.

As well as the written contract, the Courts will look at whether the person is being paid holiday and leave entitlements. If they are, then this is a good indication that the true nature of the relationship is that of an employee and employer. Though there are still many other factors to also be considered. Do you know about the new sick leave entitlements for New Zealand employees? From late July 2021 to late July 2022, employees will see their sick leave entitlements increase from 5 days to 10 days each entitlement year. These changes come as a result of the COVID-19 pandemic. The Government want to encourage people to have adequate sick leave and discourage people from “toughing it out” by coming into work and potentially getting others sick.
