It was a pleasure speaking with the AI Engineering students. As AI continues to reshape industries, understanding how to protect innovation is becoming just as important as creating it.

Many people think the biggest challenge is building something valuable. In reality, that’s only half the journey.

The real challenge begins when the idea starts gaining attention.

When investors come in, when the business grows, and when the product becomes successful.

That’s when the critical questions arise:

1️⃣Who owns the IP?
2️⃣Who is entitled to the profits?
3️⃣What happens if a founder leaves?
4️⃣What if someone claims IP infringement?
5️⃣Is the business properly structured to protect what has been built?

Having valuable intellectual property is only the beginning. Long-term success depends on having the right IP strategy to protect, manage, and maximise its value.

Yes. You absolutely can.

In Malaysia, the law doesn’t require you to register a trademark before using it.

So… why do thousands of businesses still register theirs?

👉Because using a brand and owning strong legal rights over it are two very different things.

Imagine this:

☕You open “IP Gennesis Coffee.”

Business takes off. Customers love your coffee. Over the years, you’ve invested time, money and effort into building your reputation.

Then one day…⚡

Someone else files a trademark application for “IP Gennesis Coffee” before you do.

Now, instead of focusing on growing your business, you may find yourself fighting to protect the very brand you built.

A registered trademark gives you important statutory rights, including:

✅The exclusive right to use the mark for your registered goods or services.

The answer is yes.

Copyright law does not assess whether a work is beautiful, sophisticated or commercially valuable.

Protection is not dependent on artistic quality.

Whether the artwork is a masterpiece or a simple sketch, copyright may still subsist if the legal requirements are satisfied.

(Section 7(2) of the Copyright Act 1987)
