发展商因行管令(MCO) 迟交屋,该注意什么?

1. 迟交屋赔款 (Liquidated Ascertained Damages - LAD)
算法:合同的购买价格 × 10% × 迟交屋天数/365
(Property Purchase Price × 10% × No. of Days Delayed/365)

注意:18/3/2020 - 31/8/2020 不会被计算在交屋及迟交屋赔偿期限内。发展商可向相关部长申请延长至31/3/2021。

2. 维修房子的缺陷保修期 (Defect Liability Period): 24个月
算法:领取钥匙通知信日期(Date of the Notice of Delivery of Vacant Possession) 的14天后开始计算,如果屋主在14天以内就领取钥匙,保修期则从领取钥匙那天算起。

注意:18/3/2020 - 31/8/2020 不会被计算在保修期以内。屋主可向相关部长申请延长至31/12/2020。

3. 逾期付款费(Late Payment Charges)
在18/3/2020 - 31/8/2020期间因为政府实施防控措施而无法如期缴付房屋款项给发展商,发展商不可征收逾期付款费。屋主可向相关部长申请延长至31/3/2021。

4. 发展商拒绝赔偿LAD/处理房屋缺陷该怎么办?
如果牵涉的金额超过RM50,000.00, 屋主可以去房屋仲裁庭(Tribunal for Homebuyer)进行申诉。如果超过RM50,000.00, 则可以聘请律师入禀法庭。
