Fair labour practices is defined by case law to mean practices that are even handed, reasonable, acceptable and expected from the standpoint of employer, employee and all fair minded persons looking at the unique relationship between employee and employer and good industrial and labour relations (see Kalinda vs Limbe Leaf To***co Ltd, civil cause No 542 of 1995).
What amounts to unfair labour practices invariably depends on circumstances of the case.

Please be reminded that the Employment Act of Malawi in its amendment in 2021, introduced paternity leave (for male employees) at a minimum of 2 weeks with full pay every three years.
