The Executive Director of the Competition Commission welcomed members of the media today to a press briefing held on 01 June 2026 to explain the features, operation and benefits of the recently launched ๐—ง๐—ฟ๐—ฎ๐—ฑ๐—ฒ ๐—”๐˜€๐˜€๐—ผ๐—ฐ๐—ถ๐—ฎ๐˜๐—ถ๐—ผ๐—ป ๐—ฎ๐—ป๐—ฑ ๐—–๐—ผ๐—ผ๐—ฝ๐—ฒ๐—ฟ๐—ฎ๐˜๐—ถ๐˜ƒ๐—ฒ๐˜€ ๐—”๐—บ๐—ป๐—ฒ๐˜€๐˜๐˜† ๐—ฃ๐—ฟ๐—ผ๐—ด๐—ฟ๐—ฎ๐—บ๐—บ๐—ฒ (๐—ง๐—”๐—–๐—”๐—ฃ).

In his opening remarks, ๐— ๐—ฟ ๐—ฉ๐—ถ๐—ฝ๐—ถ๐—ป ๐—ก๐—ฎ๐˜‚๐—ด๐—ฎ๐—ต, ๐—˜๐˜…๐—ฒ๐—ฐ๐˜‚๐˜๐—ถ๐˜ƒ๐—ฒ ๐——๐—ถ๐—ฟ๐—ฒ๐—ฐ๐˜๐—ผ๐—ฟ ๐—ผ๐—ณ ๐˜๐—ต๐—ฒ ๐—–๐—ผ๐—บ๐—ฝ๐—ฒ๐˜๐—ถ๐˜๐—ถ๐—ผ๐—ป ๐—–๐—ผ๐—บ๐—บ๐—ถ๐˜€๐˜€๐—ถ๐—ผ๐—ป, highlighted that TACAP serves as both an enforcement and compliance tool, providing an avenue for businesses to regularize past conduct through self-reporting, strengthen competition compliance, and help restore competition in markets. The Executive Director also emphasized the important role of the media in raising awareness of TACAP, enhancing understanding of its requirements, and enabling the business community to make informed decisions regarding participation in the programme.

It is recalled that TACAP emanates from the โ€œCompetition Commission Trade Association and Cooperatives Amnesty Programme Regulations 2026 (GN 53 of 2026)โ€ which became operational on 25 May 2026 and will remain valid until 25 November 2026.

The Competition Commission publishes its ๐†๐ฎ๐ข๐๐ž๐ฅ๐ข๐ง๐ž๐ฌ ๐จ๐ง ๐Œ๐š๐ซ๐ค๐ž๐ญ ๐ˆ๐ง๐ช๐ฎ๐ข๐ซ๐ข๐ž๐ฌ (๐‚๐‚ ๐Ÿ– ๐†๐ฎ๐ข๐๐ž๐ฅ๐ข๐ง๐ž๐ฌ) following the recent amendment to the Competition Act 2007 to include a new Section 51B -Market Inquiries.
The Guidelines establish a clear and transparent framework, ensuring procedural fairness and stakeholder engagement throughout the process.

As highlighted by the ๐„๐ฑ๐ž๐œ๐ฎ๐ญ๐ข๐ฏ๐ž ๐ƒ๐ข๐ซ๐ž๐œ๐ญ๐จ๐ซ ๐Œ๐ซ. ๐•๐ข๐ฉ๐ข๐ง ๐๐š๐ฎ๐ ๐š๐ก, โ€œ Market inquiries serve as an important instrument to identify and address broader competition issues arising from any market features. Such a tool, already used in jurisdictions such as the United Kingdom, India, South Africa, and Kenya, complements the Competition Commissionโ€™s enforcement toolkit and enhances its ability to enforce competition law more vigorously in public interest.โ€
