When a judgment of the European Court of Human Rights highlights a violation of fundamental rights, its effective implementation becomes essential.
This is why we were particularly proud to have participated in the civil society briefing organised by the for the Committee of Ministers of the Council of Europe, bringing StraLi’s perspective to the discussion.
Our contribution focused on Lavorgna v. Italy, a judgment that highlighted serious concerns regarding the use of mechanical restraint in Italian psychiatric wards and the need to address a broader systemic issue.
During the briefing, we presented StraLi’s recommendations: a clear and uniform national legal framework, independent monitoring mechanisms, greater transparency in data collection, and investment in staffing, training and alternatives to restraint.
Taking part in this important dialogue was both a meaningful recognition of StraLi’s work and a valuable opportunity to bring the voice of Italian civil society into the European discussion on the rights of people receiving mental health care.

States have a duty to rescue people in danger at sea. The UN Human Rights Committee clearly reaffirmed this, ordering Malta to act for 35 people stranded in the Maltese SAR zone, issuing for the first time an “interim measure” in situations of distress at sea.
A strong reminder of international law, still too often ignored.

Gli Stati hanno l’obbligo di soccorrere chi è in pericolo in mare. Il Comitato ONU per i Diritti Umani lo ha ribadito chiaramente, ordinando a Malta di intervenire per 35 persone bloccate nella zona SAR maltese, ed utilizzando per la prima volta lo strumento delle “interim measures” in situazioni di pericolo in mare.
Un richiamo forte al diritto internazionale, ancora troppo spesso ignorato.

In the context of migrants’ protection in the Mediterranean, in 2024 StraLi and UpRights published the report “Navigating Troubled Waters”, an advocacy project aimed at highlighting the Italian government’s responsibility for human rights violations resulting from the implementation of the Memorandum of Understanding (MoU) signed with Libya in 2017 and automatically renewed in subsequent years.
The purpose is mainly to stress the urgent need to reformulate the agreement in light of obligations under international law and to propose concrete alternatives, including the introduction of binding clauses or, failing that, the suspension or termination of the agreement.
This analysis has laid the foundations for developing and implementing concrete legal instruments, such as requests for interim measures before the United Nations Human Rights Committee, to protect migrants.

Nel contesto della protezione delle persone migranti nel Mediterraneo, nel 2024 StraLi e UpRights hanno pubblicato il report “Navigating Troubled Waters”, un progetto di advocacy dedicato a mettere in luce la responsabilita’ del governo italiano nelle violazioni dei diritti umani derivanti dall’attuazione del Memorandum d’intesa (MoU) firmato con la Libia nel 2017 e automaticamente rinnovato negli anni successivi.
L’obiettivo e’ quello di evidenziare l’urgenza di riformulare l’accordo alla luce degli obblighi di diritto internazionale e proporre alternative concrete, inclusa l’introduzione di clausole vincolanti o, in mancanza, la sospensione o rescissione dell’accordo.
Questa analisi ha posto le basi per sviluppare ed attivare strumenti giuridici concreti, quali le richieste di interim measures davanti al Comitato dei diritti umani delle Nazioni Unite, a tutela delle persone migranti.
