It is observed that when a Hindu male dies intestate many of the offices / authorities insist on production of Legal Heir Certificate. One wonders as to why such requirements / conditions are stipulated when Section : 8 (a) of the Hindu Succession Act, 1956, provides that under such circumstances, the property of the deceased shall devolve on the heirs mentioned in Class : I of the Schedule. It is nowhere provided that such heirs will inherit the property of the deceased AFTER OBTAINING LEGAL HEIR CERTIFICATE.

One more abnormality is that the Tehsildar issues a Legal Heir Certificate only to Government employees and that too for a limited purpose of pension and retirement benefits etc.

One fails to see the reason behind such provisions.
