UPDATE ON THE ISSUE OF PAYMENT OF WAGES, BY AN INTERIM ORDER OF THE HONOURABLE SUPREME COURT
Today, the Honorable Supreme Court of India has passed an Interim Order in the matters pending before it, on the issue of payment of wages to employees in light of the Order dated 29.03.2020, which is subsequently withdraw w.e.f. 18.05.2020. Thus, the wages of workers and employees which were required to be paid as per the order dated 29.03.2020 and other consequential notification was during these 50 days. The Court has issued 5 interim Measures which can be availed by all the private establishment, industries, factories and workers Trade Unions/ Employees Associations etc., which may be facilitated by the State Authorities.

The present Article is a general guideline for taking the route of Insolvency against a Company or LLP if the Company or LLP defaults in the payments of any of its dues (Financial and or Contractual).

P.S. Today, the Finance Minister Nirmala Sitharaman said that no fresh insolvency will be initiated for one year under the Insolvency and Bankruptcy Code.
At the moment MCA has extended this by 6 months, and intends to extend this by another 6 months. For MSMEs a special insolvency framework will be notified under section 240-A of IBC.
Also it appears that coronavirus-related debt will be excluded from definition of default.
