*Deemed conveyance an Eye opener post by CA Shilpa's VISWA - Right of a Member and responsibility of MC member ??*
๐1. Conveyance gives the society *ownership right of the land and building* else it remains with owners and builder developers for years together .
๐2. The coop housing *society's registration is fine with an object to get the conveyance from the owners and developers* - refer Bye law clause 5 on objects of CHS .
*๐3.Additionsl FSI* if any as per Devl Control Rules go to the person in whose name 7/12 extract or Property card is there so why to lose our right ?
*๐4. Redevelopment is possible only if you have got the conveyance* and name of coop hsg society is there in PR card or 7/12 .
๐5. CHS planning for self redevelopment can avail the loan from Mumbai district bank upto 50crs for self Redevelopment provided conveyance and other formalities are clear do that *mortgage is possible .*
*๐6. The additional FSI potential of the land can be exploited* by the CHS for its members incase of self redevelopment provided conveyance is there .
๐7. CHS see in a *better position to negotiate with the developers for corpus and additional area* if conveyance is already done .This gives you upper hand over
builder .
*๐8. U are ready to spend in lacs of rupees for your interior* where you are not owner but just occupier but when it comes to pay the fees of your consultants for conveyance or deemed conveyance you take years to decide .Its better to *pay for professionals to get quality work* and get the conveyance for society and ownership status for you as well.
๐9.Incase something goes wrong with your old building not even having conveyance , then your *owner may demand huge money to give you permission to reconstruct.*
๐10. The promoters i.e owners and developers should convey your own society land including your own flat within 4 months once 51% sales are achieved , its their *obligation under MOFA.*
๐11. Deemed conveyance comes into picture when the above obligation is not met by the lsnd owners and developers for years together and you as a society can move the *deemed conveyance application with your own DDR who is a competent authority* and executes your conveyance deed .
๐12. You don't need Ur land owners, developers etc ..just decide and go for deemed conveyance which is *easiest and practicable way of getting your own land and building registered in society's name .*
๐13.Remember... *you have paid not only for construction cost but your huge portion of flat purchase amount is towards land cost* so it's your right to get your flat as well as land conveyed in the name of the society .
๐14..So, dear members and MC members , *pls think wise, take quick decision and be practical , be pro active and be bold in taking decision of deemed Conveyance atleast in this AGM .*
๐15..If not now then one more year gone..since *Conveyance is the agenda which is discussed in this AGm and then in next AGM.*
๐16. So *let's fight for our right without allowing anyone to take your own bite ...*
