Budget 2026 has quietly dropped a big signal for India’s digital infrastructure play: a long-horizon tax incentive framework for cloud players using India-based data centres.

Key proposal (Finance Bill 2026):

• Introduces a new exemption for a notified foreign company on income in India (or deemed in India) from procuring “data centre services” from a “specified data centre” available up to FY ending 31 March 2047.

• “Specified data centre” is tightly defined: MeitY-notified, set up under an approved scheme, and owned & operated by an Indian company.

• Guardrails are equally important:
o Foreign company must not own/operate the DC’s physical infrastructure/resources
o All sales to users in India must be routed via an Indian reseller company
o Prescribed reporting compliances will apply

Why it matters:
• Long-term certainty for global cloud & hyperscalers
• Strong tailwind for India DC developers/colocation ecosystem
• Encourages clean structuring (infra ownership in India, India sales ring-fenced) and reduces dispute risk

What to watch next: MeitY’s “approved scheme” + notifications (and the reporting rules) will be the real playbook for how quickly this can be implemented.
