Right2Homes is currently supporting a Constitutional Challenge Darcy -v- Minister of Justice & Attorney General (Supreme Court Record No. 2014/755P); lodged in the Court of Appeal on June 5th 2015. Challenging the retroactive nature of the Land & Conveyancing Law Reform Act 2013, enacted hastily by Government to circumvent the Justice Dunne ruling of 2009 which prevented banks from seeking repossession of family homes. The Challenge process will force the Courts to take account of the unconstitutional aspects of the 2013 Act and assist with demands that they refrain from granting Possession Orders to banks until such time as this matter is finally determined in the Supreme Court. The action will highlight the unfairness and inequality of the processes currently being adopted in favour of bailed-out financial institutions at the expense of tens of thousands of distressed family homeowners.
