Spain has officially removed Gibraltar from its list of non-cooperative tax jurisdictions, bringing to a close a designation that has stood for 35 years.

The change has now been published in the Spanish Official Gazette (BOE) and is in force.

The decision aligns Spain’s position with Gibraltar’s long-established international standing as a transparent and cooperative financial centre. Gibraltar has been on the OECD white list since 2009 and has never appeared on the EU list of non-cooperative tax jurisdictions.

For businesses and individuals with cross-border interests between Gibraltar and Spain, the change brings welcome clarity and reflects the evolution of Gibraltar’s regulatory framework over recent years.

As Sovereign Group CEO Gerry Kelly commented:
“Spain's decision to formally remove Gibraltar from its list of non-cooperative tax jurisdictions is a welcome and long-overdue recognition of Gibraltar's commitment to international standards of tax transparency and regulatory cooperation.
Gibraltar has consistently demonstrated that it is a well-regulated, responsible international finance centre, and this decision brings Spain’s position into line with that reality.
For businesses, investors and families with interests on both sides of the border, the removal provides greater certainty and reflects the positive progress that has been made in cross-border cooperation in recent years.”
