3. Restrictions on Non-Ukrainian Nationals
Decision: Rejection of the proposal to withdraw Status S from non-Ukrainian nationals, except for refugees recognized by Ukraine.

Statut S : Décisions importantes du Parlement suisse

Le Conseil national a récemment pris des décisions majeures concernant le statut de protection S, mis en place pour protéger les personnes fuyant le conflit en Ukraine. Voici les points essentiels :
1. Critères régionaux pour la protection
Décision : Adoption de la proposition visant à limiter le statut S aux personnes résidant dans des régions ukrainiennes occupées par la Russie ou où des combats intenses sont en cours.
2. Retrait du statut pour certaines régions
Décision : Rejet de la proposition de retirer le statut S aux personnes venant de régions sous contrôle ukrainien sans conflits actifs.
3. Restrictions pour les ressortissants non ukrainiens
Décision : Rejet de la proposition visant à retirer le statut S aux ressortissants non ukrainiens, à l’exception des réfugiés reconnus par l’Ukraine.

- Facilitated access to the Swiss labour market for residents with F permit.
Provisionally admitted foreign nationals working in a canton other than the one in which they are staying will now be able to move their domicile more easily. Access to the labour market will also be simplified for other categories of foreign nationals. At its meeting on May 1, 2024, the Federal Council set June 1, 2024 as the date for the corresponding amendments to the law and ordinances to come into force. It also discussed how to proceed with regard to travel restrictions outside Switzerland for asylum seekers and foreign nationals.

Les personnes admises à titre provisoire qui travaillent dans un canton autre que celui où elles séjournent pourront désormais y déplacer leur domicile plus facilement. En outre, l’accès au marché du travail sera simplifié pour les autres catégories d’étrangers. À sa séance du 1er mai 2024, le Conseil fédéral a fixé l’entrée en vigueur des modifications de loi et d’ordonnances correspondantes au 1er juin 2024. Il a par ailleurs discuté de la manière de procéder en ce qui concerne les restrictions de voyage hors de Suisse pour les personnes relevant des domaines de l’asile ou des étrangers

Good news for third-country nationals (outside the EU/EFTA): the Federal Department of Justice and Police is introducing a simplified work authorisation procedure for them.

To address the shortage of skilled labour in Switzerland, the Confederation has decided to ease the admission requirements for third-country nationals.

From 1 February 2023, employers in affected professions, such as doctors or IT specialists, will be able to hire third-country nationals with less restrictive conditions, in particular, the requirement of professional qualifications. Moreover, the cantonal migration authority will no longer have to strictly examine the condition of priority for Swiss or European workers. This is a major step forward for employers in Switzerland, as this condition required considerable administrative work.

The cantons are also empowered to authorise, through the simplified procedure, the transition from paid employment to self-employment for foreign workers who are already in Switzerland and who already have a residence permit. Since this decision came into force, the procedure is also quicker for these categories of work permit applications. They will no longer need the approval of the State Secretariat for Migration.
