We are thrilled to announce that we have successfully represented our client, a proud veteran of the Israel Defense Forces, in a defamation lawsuit against the notorious Foodbenders restaurant and its proprietor.

Our client was maliciously called a terrorist and a killer (among other things) for the sole reason that he served in the IDF.

Following over three (3) years of litigation and a full contested trial, the judge on Friday released her detailed decision finding that Foodbenders maliciously defamed Mr. DeLuca. Notwithstanding that certain Instagram posts were up for no more than 24 hours, she ordered the Defendants to pay $75,000 in general and aggravated damages and $10,000 in punitive damages. She also granted a permanent injunction.

We would like to thank Shai for his courage in pursuing this case to its just conclusion, and the Lawfare Project for acting as our co-counsel and strategic partner.

Being a Jew and Israeli who sacrifices years on behalf of the State of Israel and its people by serving in the military is not license to defame.

As the trial judge aptly put it in awarding punitive damages,

“these kinds of statements not only affect people’s reputations, but they also contribute to prejudice, antisemitism and intolerance and have the potential to incite violence.”
