Understanding the Charter can be a challenge. In this series we will explain some of the important or interesting sections of the Charter and some decisions of the Courts that discuss those sections!
There are some foundational sections must be understood and considered in any Charter analysis:
Section 1 allows infringement on certain Charter rights "subject only to such reasonable limits prescribed by law as can be demonstrably justified in a free and democratic society."
Section 24.(1) allows anyone whose rights or freedoms have been infringed or denied may apply to a court of competent jurisdiction to obtain such remedy as the court considers appropriate and just in the circumstances.
So what is "demonstrably justified?" What are appropriate or "just" remedies?
