Arrest by private persons and procedure on such arrest
59.(1) Any private person may arrest any person who in his view commits a non-bailable and cognizable offence, or any proclaimed offender, and without unnecessary delay, shall make over any person so arrested to a police-officer, or, in the absence of a police-officer, take such person or cause him to be taken in custody to the nearest police-station.
(2) If there is reason to believe that such person comes under the provisions of section 54, a police-officer shall re-arrest him.
(3) If there is reason to believe that he has committed a non-cognizable offence, and he refuses on the demand of a police-officer to give his name and residence, or gives a name or residence which such officer has reason to believe to be false, he shall be dealt with under the provisions of section 57. If there is no sufficient reason to believe that he has committed any offence, he shall be at once released.

General Duty of the Schedule Bank to Assist in the Criminal Investigations/ Proceedings.
Whenever a criminal proceeding is pending before any court or an event in under criminal investigation or inquiry, generally court can summon any natural or legal person to bring those evidence/s before court which are necessary or desirable for the purpose. Also designated Investigating Officer of the police i.e. I/O by a written request or order may also ask for the same, pending investigation/inquiry.
However, if any such evidences which belong to Schedule Banks are not under any obligation to disclose to the I/O of the Police Officer, such evidences which relates to the Bank accounts or may disclose any information relating to the Bank account of any person unless:
a) I/O is permitted in writing by the Sessions Judge for investigation of the offence for which accused is charged under “certain specific sections of the Penal Code”; and
b) In case of any investigation of the offence for which accused is not charged under “certain specific section of the Penal Code”, written permission of the High Court is required;
Unless the I/O can provide any written order from either Sessions Judges Court or High Court, the scheduled banks of Bangladesh is not under any legal obligation to handover/produce, required evidences which belongs to bank, and which may disclose bank account or information relating to the bank account, to the I/O of police relating to pending investigation. Any evidences produced or provided by the Bank has to comply with Evidence Act/s.
