As His Honour pointed out in Thillagaratnam v Doan, the purpose of litigation is “to obtain actual and not merely theoretical relief”. Unfortunately, this is an example of too many instances where parties unnecessarily incurred significant (potentially unrecoverable) legal fees without obtaining actual relief. Having recently advised on a potential nuisance claim, we also cannot understand why a nuisance action had not been brought against the neighbour. The most important step in litigation is getting a clear strategy from the outset and defining what a win looks like, not just following the steps to get to a trial.
