We recently reviewed a building contract where the client had provisional sums for:

➡ Hard digging - $1,500
➡ BAL requirements - $6,000
➡ Delayed titles - $10,000

However, when they received their building contract, all of these “provisional sums” were included into the base price of the home.

Here’s the issue:

If some of these items never end up being required during construction, where is the documentation confirming the client receives that money back?

If there’s no clear variation process, refund clause, or cost reconciliation, buyers may end up paying for allowances that were never actually used.

This is why understanding your contract matters just as much as understanding your quote.

Before signing, make sure you know:
