Fun fact: a trade mark doesn't have to be a logo.
It can be a word, a colour, a shape, or even a sound. Think Tiffany blue. The Intel chime. McDonald's arches.
If it says "this is us" to your customers, it's worth protecting. A registered trade mark is how you do that properly.

A client came to me not long ago with a brand they'd invested thousands in. Logo, website, the full package. Stunning work.
We searched the mark. There was a conflict.
I wasn't surprised, which is the depressing part.
The trade mark search needs to happen before you engage a designer — not after. Your brand name and identity should be built on something you actually own the right to use.

In Australia, trade marks are registered for 10 years — and then they must be renewed. Miss the window, and you could lose the protection you worked hard to secure.
On top of that, your trade mark needs to be actively used. An unused trade mark can be challenged and removed by a third party.

Did you know that trade marks are registered in classes — and that getting those classes right from the start matters more than most people realise?
IP Australia uses the Nice Classification system, which divides goods and services into 45 classes. Your trade mark only protects you in the classes you register it in — so if your business expands into new areas, that protection may not automatically follow.
Filing in too few classes leaves gaps. Filing in too many can attract objections or create unnecessary costs.
