QUALIFIED OPPORTUNITY ZONES

On December 22, 2017, the Tax Cuts and Jobs Act (TCJA) created Qualified Opportunity Zones, a tool for promoting long-term investment in low-income communities.

The federal tax bill enables the governor to designate certain census tracts as Opportunity Zones. Investments made by individuals through special funds in these zones for the acquisition of real estate or incorporation of businesses would be allowed to defer or eliminate federal taxes on capital gains if held for more than 10 years.

The program encourages investors to re-invest previously unrealized capital gains into Opportunity Funds in exchange for a temporary tax deferral, partial tax reduction on the initial capital gain, and elimination of capital gain tax on the new investment.
