CFIUS: Understanding Foreign Investment Restriction, and Cloud Control: Export Control Basics, Rules, and Emerging Technology

On September 17, 2019, the U.S. Department of Treasury issued two new proposed rules for the Committee on Foreign Investment in the United States (CFIUS) implementing the Foreign Investment Risk Review Modernization Act (FIRRMA), which was enacted in August 2018. The first presenter provides an overview of the proposed rule changes, which include, among other things, FIRRMA’s expansion of CFIUS’ jurisdiction to non-controlling investments in U.S. businesses engaged in critical technology, critical infrastructure, and sensitive personal data.

Most people think that export controls apply to dangerous items, like bombs, guns, or ammunition, and while that is true, they also apply to much more than that, and if you aren’t careful you can find yourself in a precarious situation. The second presenter provides enough knowledge to be dangerous, which means knowing the right questions that need to be asked of your clients when dealing with exports.
