Hanwha Solutions has concluded its patent dispute with the US solar company Maxeon, resolving legal uncertainties to target the North American market. This settlement is interpreted as a strategic decision to secure momentum for local business by blocking litigation risks surrounding next-generation solar technology early on.
According to the United States District Court for the Eastern District of Texas on June 19 local time, the plaintiff Maxeon and the defendant Hanwha Solutions submitted a joint motion for dismissal and agreed to end the dispute. The motion specified that all claims raised by Maxeon are withdrawn under the condition of ‘dismissal without the possibility of refiling’. However, legal room was left by including a provision allowing Hanwha Solutions’ counterclaims and defenses to be raised in other future trials.
This dispute began in April 2024 when Maxeon filed a lawsuit claiming that Hanwha Solutions’ ‘TOPCon’ solar cell technology infringed on its patents. Maxeon claimed that its predecessor, SunPower, developed the technology for the first time in the industry, and had been demanding a sales ban and compensation for damages regarding Hanwha Qcells’ ‘Q.ANTUM NEO’ technology and ‘Q.TRON’ series modules.
The industry is noting that although both sides did not disclose specific settlement conditions, they withdrew the lawsuit while bearing their respective attorney fees. This appears to be the result of reaching an amicable settlement before proceeding to a lawsuit on the merits, and from Hanwha Solutions’ perspective, it has shaken off a major obstacle that was holding back its North American business.
Hanwha Solutions expressed its position that it respects Maxeon’s decision to withdraw the lawsuit, emphasizing that it will strive to create a sound market where technological prowess and innovation are protected. With this decision, the solar business that Hanwha Group is promoting on a company-wide level is expected to gain further momentum.
Currently, the Qcells division of Hanwha Solutions is expanding its US market share under the leadership of Hanwha Group Vice Chairman Kim Dong-kwan. The company is focusing on strengthening its local production capabilities, such as investing approximately 3 trillion won ($2.31 billion) to build ‘Solar Hub’, the largest integrated solar production base in North America, in Georgia, US. Hanwha Solutions, which ranked first in the US residential solar module market share last year, is expected to further solidify its dominance in the North American energy market with the conclusion of this lawsuit.
